YOUR SOLE REMEDY FOR ANY BREACH OR DEFAULT OF THIS AGREEMENT BY kmcfinancials.com OR WEBSITE OWNER SHALL BE A RETURN OF ANY FEES PAID TO kmcfinancials.com DURING THE THREE(3) MONTHS IMMEDIATELY PRECEDING THE EVENTS GIVING RISE TO THE CLAIM OR WEBSITE OWNER FOR ANY SERVICES OR PRODUCTS PURCHASED OR [$500], WHICHEVER IS GREATER.

5. Indemnification. Arbitration may be conducted by telephone, video conference, or based solely on written submissions, and will take place in Stroudsburg Pennsylvania, unless otherwise required by law. The arbitrator’s decision shall be final and binding, and judgment on that award may be entered in any court of competent jurisdiction.

Either party may bring an individual action in the small‐claims court located in the State of Pennsylvania, provided that the claim falls within that court’s monetary and subject‐matter jurisdiction. All claims must be brought on an individual basis and not as part of any class, consolidated, or representative action.

15.Waiver. The failure of Website or Website Owner to exercise or enforce any right or provision of this Agreement shall not operate as a waiver of such right or provision. Any waiver of this Agreement by Website or Website Owner must be in writing and signed by an authorized representative of the Website Owner.

16.Severability. If any provision is found to be invalid, the remaining provisions will be in full force and effect.
